1Licence, not sale

kavilo is proprietary software owned by lastfurlong.com. It is licensed, not sold. Nothing in these terms transfers ownership of any intellectual property, and no rights are granted to the kavilo source code.

2What you may do

Subject to these terms and to holding a current licence, you are granted a non-exclusive, non-transferable, revocable licence to install and run unmodified official builds of kavilo for your own personal or internal business purposes.

This licence is granted to the person or organisation named when the licence was issued, for use on the machines that licence identifies.

3A current licence is required to run kavilo

kavilo requires a valid licence to run. Licences are issued for a term of one year from the date of issue and stop being valid when that term ends.

A licence is issued for a specific installation, identified by a fingerprint the software generates locally. The fingerprint is a random value created on first run and then hashed; it is not derived from your hardware and contains no information about your machine.

When a licence expires, the right granted in clause 2 ends. Renewal is free and is requested the same way as the original licence.

Nothing in these terms permits removing, disabling, bypassing or interfering with the licence mechanism, or running kavilo without a valid licence.

4What you may not do

Except to the extent that applicable law expressly prohibits the restriction, you may not, in whole or in part: copy, publish, distribute, sublicense, sell, rent, lease or otherwise make kavilo available to any third party; modify, adapt, translate or create derivative works of kavilo; reverse engineer, decompile or disassemble kavilo or otherwise attempt to derive its source code; or remove or obscure any proprietary notice.

You may not use any trade mark of lastfurlong.com without prior written permission.

5Information collected when a licence is issued

To issue a licence we collect the name, email address and, if given, the company and telephone number supplied on the request form, together with the installation fingerprint described in clause 3 and the version of these terms accepted at that time.

The email address is used to confirm the request and to deliver the licence. We do not sell this information. kavilo itself does not report your use of it back to us: licences are verified locally by the software, without contacting our servers.

6Third-party components

Third-party components distributed with kavilo remain subject to their own licences. Those licences govern those components and are unaffected by these terms. Where a component’s licence conflicts with these terms, that licence prevails for that component.

7No warranty

kavilo is provided “as is”, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement.

kavilo operates other software and services on your instruction, including large language models that can produce incorrect output. You are responsible for what you instruct it to do and for reviewing what it produces.

Nothing in these terms excludes any liability that cannot lawfully be excluded.

8Limitation of liability

Subject to clause 7, in no event shall the copyright holder be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with kavilo or its use or other dealings in kavilo.

9Termination

This licence terminates automatically if you breach these terms. On termination you must stop using kavilo and destroy all copies in your possession. A licence may also be withdrawn at renewal.

10Changes to these terms

These terms may be revised. A revision is published as a new version at its own address, and the version in force for your licence is the one recorded when that licence was issued. Revisions do not alter a licence already granted for its remaining term.
